1. Acceptance of Terms
By accessing or using the SideStall mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
SideStall is operated by Koviq Group Pty Ltd (ACN 696 153 821) ("SideStall", "we", "us", or "our"). We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
2. Service Description
SideStall is a discovery platform that connects customers with local roadside stall owners, home gardeners, and artisan producers across Australia. The Service allows stall owners to list their stalls and products, and allows customers to discover and navigate to these stalls.
Important: SideStall is a marketplace discovery tool only. We do not facilitate transactions, process payments, or act as an intermediary in any sale. All transactions between customers and stall owners occur directly between those parties, and SideStall bears no responsibility for the quality, safety, legality, or availability of any products or services offered through stalls listed on our platform.
SideStall is a directory, not a regulator. We do not verify, certify, inspect, or monitor any seller's compliance with food safety regulations, licensing requirements, or any other regulatory obligations. The presence of a stall listing on SideStall does not constitute an endorsement, verification, or representation that the seller holds any particular licence, registration, or permit.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorised use of your account
You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Stall Owner Responsibilities
If you list a stall on SideStall, you agree to:
- Provide accurate information about your stall, products, and availability
- Comply with all applicable Australian federal, state, and territory laws and regulations, including food safety standards, labelling requirements, and local council permits
- Obtain and maintain all required food safety registrations, licences, and permits applicable to your products and location before listing on SideStall — including, where applicable, registrations required under state food safety authorities (such as PIRSA in South Australia, or the equivalent authority in your state or territory)
- Ensure all products you list are safe, legal, and fit for their intended purpose
- Keep your stall information and product listings up to date
- Respond to customer inquiries in a timely and professional manner
- Not list prohibited or illegal items (see Prohibited Items below)
Prohibited Items
The following items may not be listed or sold on SideStall:
- Alcohol and alcoholic beverages — including beer, wine, spirits, cider, and any beverage containing alcohol. Selling alcohol requires a liquor licence under Australian state and territory legislation, and SideStall does not support the age verification or licensing checks required for lawful alcohol sales.
- Tobacco and vaping products — including cigarettes, loose tobacco, e-cigarettes, vape liquids, and related accessories
- Firearms, weapons, and ammunition
- Illegal drugs and controlled substances
- Prescription medications and pharmaceuticals
- Hazardous materials — including chemicals, pesticides, and flammable substances (excluding commercially packaged cleaning products)
- Stolen, counterfeit, or recalled goods
This list is not exhaustive. SideStall reserves the right to remove any listing that we determine, at our sole discretion, to be inappropriate, unsafe, or in breach of applicable laws. If you are unsure whether a product is permitted, contact us at hello@sidestall.au before listing.
Food Safety and Regulatory Compliance
You are solely responsible for understanding and complying with all food safety regulations that apply to your products in your state or territory. This includes, but is not limited to, any requirements for food business registration, food handler training, labelling, allergen disclosure, and safe food handling practices.
SideStall does not verify any seller's food safety registration, licensing status, or regulatory compliance. We are a discovery directory — not a food safety authority, inspector, or regulator. You must not rely on your listing being accepted on SideStall as any form of approval or verification of your compliance with applicable laws.
You acknowledge that you are solely responsible for your stall, products, pricing, and compliance with all applicable regulations. SideStall does not verify, endorse, or guarantee the accuracy of any stall listing. If you are unsure of your regulatory obligations, you should contact the relevant food safety authority in your state or territory before listing products on SideStall.
Right to Remove Listings
SideStall reserves the right to remove, suspend, or hide any stall listing at any time and without notice if we reasonably believe, or are notified, that a listing may involve products that are unsafe, illegal, or in breach of applicable regulations. This right exists regardless of whether we have verified the listing and does not create any obligation on SideStall to monitor or investigate listings.
5. User Conduct
When using the Service, you agree not to:
- Post false, misleading, or deceptive content
- Harass, abuse, or threaten other users
- Use the Service for any unlawful purpose
- Attempt to interfere with or disrupt the Service
- Create multiple accounts for deceptive purposes
- Scrape, mine, or extract data from the Service
- Impersonate any person or entity
- Upload malicious software or harmful content
SideStall provides tools for users to block and report other users and content. If you are blocked by another user, you will not be able to message them and your content may be hidden from their view. If content you post is reported by multiple users, it may be automatically flagged for review and temporarily hidden. We reserve the right to review reported content and take action, including removing content or suspending accounts, at our sole discretion.
6. Content and Intellectual Property
You retain ownership of content you submit to the Service (photos, descriptions, product listings). By posting content, you grant SideStall a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.
The SideStall name, logo, and all related marks, designs, and slogans are trademarks of Koviq Group Pty Ltd. You may not use these marks without our prior written permission.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The information on the Service is accurate or complete
- Any products found through the Service will meet your expectations
- Stalls listed on the Service are currently open or have available stock
- Any stall owner holds valid food safety registrations, licences, or permits
- Any products listed are safe, fit for consumption, or compliant with applicable regulations
- Any information provided by stall owners (including product descriptions, ingredients, allergen information, or pricing) is accurate, current, or complete
Assumption of Risk: You acknowledge that any interaction with stall owners and any purchase of products discovered through the Service is entirely at your own risk. SideStall is not a party to any transaction between you and a stall owner, and we have no control over the quality, safety, legality, or accuracy of any products, listings, or communications between users.
8. Limitation of Liability
To the maximum extent permitted by Australian law, SideStall shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to:
- Any issues with products purchased from stalls found through the Service
- Food safety incidents, foodborne illness, allergic reactions, or any adverse health effects arising from products sold by stall owners
- A stall owner's failure to hold required licences, registrations, or permits
- Any transaction, agreement, or dispute between you and a stall owner
- Loss of data or business interruption
- Inaccurate stall locations, product descriptions, or availability information
- Personal injury or property damage arising from visiting a stall or consuming products
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you have paid to SideStall in the 12 months preceding the claim, or AUD $100, whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless Koviq Group Pty Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service or violation of these Terms
- Your breach of any applicable law or regulation
- Any content you post or submit through the Service
- If you are a stall owner: any claim arising from the products you sell, including but not limited to food safety incidents, regulatory non-compliance, failure to hold required licences or registrations, personal injury, property damage, or allergic reactions
- Any dispute between you and another user of the Service
This indemnification obligation will survive termination of your account and these Terms.
10. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (Schedule 2), or any equivalent state or territory legislation, that cannot be excluded, restricted, or modified by agreement ("Non-Excludable Guarantees").
To the extent that SideStall is liable under any Non-Excludable Guarantee, our liability is limited (at our option) to the re-supply of the relevant service or payment of the cost of having the service re-supplied, to the maximum extent permitted by law.
For the avoidance of doubt, the consumer guarantees relating to goods under the Australian Consumer Law apply to the products sold by stall owners — not to SideStall. SideStall does not supply, manufacture, import, or sell any goods listed on the platform. Any claim relating to the quality, safety, or fitness of products must be directed to the stall owner who sold those products.
11. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be governed by the laws of South Australia, Australia. You agree to first attempt to resolve any dispute informally by contacting us at hello@sidestall.au . If the dispute cannot be resolved informally, it shall be submitted to the courts of South Australia.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive.
